Terms of Service

1. Using the service

You may use PodcastMy only in compliance with these Terms and applicable law. You are responsible for the activity on your account, for maintaining the accuracy of the phone number you use to sign in, and for using the app only for lawful, non-abusive purposes.

2. What PodcastMy provides

PodcastMy provides a live AI conversation experience that can respond to session context such as selected topics, pace, and optional heart-rate input from a connected wearable. The service is intended for reflection, conversation, and creative or personal use. It is not a medical device, not a clinical tool, and not an emergency service.

3. Accounts and access

Some features require sign-in with a phone number. You agree to provide a number you are authorized to use and to complete any verification steps required to access the service. You can also initiate account deletion directly in the app at Settings > Account > Delete Account. We may suspend or limit access if we detect fraud, abuse, payment issues, or other misuse.

4. Minutes, purchases, and billing

Paid live sessions may require a positive minute balance. Purchases are handled through Apple’s App Store, and Apple’s purchase terms, billing rules, and refund policies apply to the extent required by law and the App Store terms. PodcastMy may verify transactions, maintain a usage wallet, debit minutes during live sessions, and stop a session if minutes are exhausted.

5. Your content

You are responsible for the content you speak, submit, or store through the app. If you enable local transcript or recording storage, you are responsible for what is retained on your device. You must not use PodcastMy to violate privacy rights, intellectual property rights, or applicable law.

6. Acceptable use

• Do not attempt to disrupt, reverse engineer, or interfere with the app, purchase flow, or backend services.
• Do not use the service for unlawful harassment, impersonation, fraud, or abusive content.
• Do not misuse App Store transactions, wallet credits, or usage metering.

7. Availability and changes

PodcastMy may change, suspend, or discontinue features at any time. Live AI features depend on third-party services, connectivity, and device permissions, so uninterrupted availability is not guaranteed.

8. Disclaimers

PodcastMy is provided on an “as is” and “as available” basis to the maximum extent permitted by law. We do not guarantee that the service will always be error-free, uninterrupted, or suitable for every purpose. The app does not provide medical, mental health, or emergency guidance, even if it references heart rate, effort, stress, or recovery.

9. Limitation of liability

To the fullest extent permitted by law, PodcastMy and its operators will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of data, profits, goodwill, or business opportunities arising from your use of the service.

10. Account deletion

If you delete your account in the app, the PodcastMy account, access to the associated minute wallet, and the backend usage records tied to that account are permanently closed. Any unused minute balance remaining on the deleted account cannot be restored. Apple purchase records, refunds, and other records Apple controls remain subject to Apple’s own terms and policies.

We may retain records where law requires or permits retention for security, fraud prevention, tax, accounting, or dispute resolution purposes.

11. Termination

You may stop using PodcastMy at any time. We may suspend or terminate access if needed to protect the service, enforce these Terms, address legal obligations, or respond to misuse.

12. Changes to these terms

We may update these Terms as the service evolves. When we do, we will update the effective date above. Continued use of the service after an updated version becomes effective means you accept the revised Terms.

15. Consumer dispute resolution

HOLI Collective GmbH is not willing or obliged to participate in dispute resolution proceedings before a consumer arbitration board, unless a mandatory legal obligation applies in a specific case.
